Welcome to Graphyt!

These Terms and Conditions (“Terms”) govern your use of the Graphyt application and services provided by Onionskin (“we,” “us,” or “our”). By creating an account, uploading content, or using any part of our services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use the application.

1. Eligibility

1.1 You must be at least 16 years old to use Graphyt. By using the application, you represent and warrant that you meet this age requirement.

2. Account Creation

2.1 To access certain features of the application, you must create an account. You agree to provide accurate and complete information during the registration process.

2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.3 If you suspect any unauthorized use of your account, you must notify us immediately.

3. Content Upload and Usage

3.1 As a user, you may upload comic books, voiceovers, and other content (collectively, “User Content”) to Graphyt.

3.2 You retain ownership of any intellectual property rights that you hold in the User Content. By uploading content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, store, display, reproduce, and distribute your content on Graphyt and its associated platforms.

3.3 You agree not to upload, post, or share any content that is unlawful, harmful, defamatory, obscene, abusive, invasive of another’s privacy, or otherwise objectionable (“Prohibited Content”). This includes, but is not limited to, NSFW (Not Safe For Work) content.

3.4 We reserve the right to remove or disable access to any content that violates these Terms or our policies.

4. Copyrighted Material Policy

4.1 No Copyrighted or Infringing Material
By using the Graphyt app, you agree that any content, including but not limited to comics, artwork, illustrations, and other forms of creative expression, must be your original work, or you must have explicit rights to use, publish, and distribute it. Graphyt strictly prohibits the submission, publication, or distribution of any material that infringes upon the copyrights, trademarks, or intellectual property rights of others.

4.2 Sourced or Copyrighted Content Prohibited
Any comic or artwork that is found to be sourced from copyrighted material, or that incorporates copyrighted elements without proper authorization, will be in violation of Graphyt’s policies. This includes, but is not limited to, characters, plotlines, settings, or designs that are copied, adapted, or inspired by existing copyrighted works, unless you have obtained legal permission from the copyright holder.

4.3 Content Removal and Penalties
If it comes to the attention of Graphyt’s team that content uploaded to the platform violates these terms, Graphyt reserves the right to immediately remove the content in question without prior notice to the user. Repeated violations may result in account suspension or permanent banning from the platform.

4.4 Reporting Infringing Content
Graphyt encourages its users to report any content that they believe infringes upon their own or others’ copyrights. Upon receiving a valid copyright infringement claim, the Graphyt team will promptly review the claim and take appropriate action.

5. User Conduct

5.1 You agree to use Graphyt in accordance with all applicable laws and regulations.

5.2 You agree not to misuse the application by engaging in prohibited activities such as spamming, phishing, hacking, or any other actions that could harm the application or its users.

6. Privacy and Data Protection

6.1 We are committed to protecting your personal data. Our use of your data is governed by our Privacy Policy, which is compliant with the General Data Protection Regulation (GDPR).

6.2 By using Graphyt, you agree that we may collect, store, and process your personal data in accordance with our Privacy Policy.

6.3 You have the right to access, rectify, erase, or restrict the processing of your personal data. You may exercise these rights by contacting us at onionskinproduction@gmail.com.

7. Intellectual Property

7.1 All content, trademarks, logos, and other intellectual property on Graphyt are owned by us or our licensors and are protected by intellectual property laws.

7.2 You may not use, reproduce, or distribute any content from Graphyt without our prior written permission, except as allowed under these Terms.

8. Termination

8.1 We reserve the right to suspend or terminate your account and access to the application at our discretion if you violate these Terms or engage in conduct that we deem harmful to the application or its users.

9. Limitation of Liability

9.1 To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of Graphyt.

9.2 Our total liability to you for any claims arising out of or relating to these Terms or your use of the application shall not exceed the amount paid by you, if any, for accessing Graphyt.

10. Changes to Terms

10.1 We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on Graphyt and updating the “Last Updated” date at the top of this document.

10.2 Your continued use of the application after the changes take effect constitutes your acceptance of the updated Terms.

11. Governing Law

11.1 These Terms are governed by and construed in accordance with the Constitution of India, without regard to its conflict of law principles.
